生成式人工智能赋能气候治理场景的法律规制

    Legal Regulation of Generative Artificial Intelligence in Climate Governance Scenarios

    • 摘要: 随着“双碳”目标的稳步推进,智能化与绿色化深度融合已成为“十五五”时期绿色低碳发展的新引擎,以数智技术赋能绿色转型成为智能化与绿色化协同转型的具象化场景。在数智技术升级迭代的背景下,以通用大模型为技术底座的生成式人工智能,正以“大模型+具体应用”的模式强势赋能气候治理场景,使传统的气候治理逐渐向新型“气候智理”转型。鉴于气候治理场景的智能化应用尚处于探索阶段,在与生成式人工智能系统衔接的过程中,不可避免地形成内生技术风险与衍生算力供给碳排放风险。为了调控技术创新与低碳发展之间的内在张力,面对弹性技术风险,尝试以包容性法律治理缓解算法偏见,以碳排放数据分类分级制度平衡透明性与算法黑箱之间的关系。面对气候治理场景提出的规范化需求,既要释放气候治理大模型的赋能空间,还应搭建技术治理与法律治理的协同场景,形成技术融贯型气候法律治理框架,为增强绿色发展动能保驾护航。

       

      Abstract: With the steady progress toward carbon peaking and carbon neutrality, the deep integration of intelligence and greenness has become a new engine driving low-carbon development during the 15th Five-Year Plan period. Empowering green transformation through digital intelligence technologies has emerged as a concrete manifestation of the coordinated transformation between intelligentization and greening. Against the backdrop of continuous upgrades in digital intelligence technologies, generative artificial intelligence (AI), which builts upon general-purpose foundation models, is empowering climate governance scenarios through a “large model+specific application” paradigm, propelling the shift from traditional climate governance toward a new model of “intelligent climate governance”. Given that intelligent applications in climate governance scenarios are still in an exploratory stage, the integration of generative AI systems inevitably gives rise to endogenous technological risks and derivative carbon-emission risks. To manage the inherent tension between technological innovation and low-carbon development, it is necessary to establish an inclusive legal governance framework that mitigates algorithmic bias in the face of elastic technological risks, and to employ the classification and grading of carbon emission data to balance transparency with the opacity of algorithmic black boxes. In response to the standardization demands, it is essential not only to unleash the empowering potential of large climate governance models, but also to build collaborative mechanisms between technological solutions and legal frameworks. This will facilitate a technology-integrated legal regulatory system for climate governance to reinforce the momentum of green development.
