Abstract:
The rule of videotaping of interrogation will help to regulate the behaviors of interrogation and to protect the interests of suspects in criminal procedure. However, it has drawbacks including the vague of category, the deficiency of judicial review, the lack of procedural sanction etc. The videotape of interrogation belongs to audio-visual material on proof of procedural matters, while it's confession on proof of substance matters. It's necessary to establish procedural sanction for serious violations of the rule by depriving its evidence capability. In the case of substantive differences between interrogation record and videotape, the latter has stronger probative value. Based on videotape of interrogation to establish facts, it still should follow the corroboration rule.
