Abstract:
Because the lax and campaign-style law enforcement of the pedestrian traffic violation, unreasonable road set, and marginalized pedestrian traffic status, penalties of pedestrian violations present a dilemma in law enforcement. This study carried out reviews of pedestrian violation from the perspectives of people and vehicles' unequal road rights and responsibilities, the abuse of tilt protection principles, the law of large numbers and utilitarianism and so on, in order to find out the deep reasons of pedestrian violations. On this basis, it further demonstrated the feasibility of the punishments, and proposed to set enforcement grace period, strengthen law enforcement forensics, innovate means of punishment, and improve the penalties. It adhered to the principle of finality and took necessary duties of care in order to make law enforcement measures more regulated and feasible.
